PROPOSED LOURENS RIVER STORMWATER OUTLETS, LITTER TRAPS AND DETENTION POND, SOMERSET WEST

 

Description:

The City of Cape Town is proposing to construct five new stormwater outlet structures and associated litter traps at strategic points along the Lourens River, as well as a stomrwater detention pond on Erf 3308, as part of the emergency flood alleviation measures currently being implemented in Somerset West.  The proposed activities require environmental authorisation and CCA has thus been appointed to undertake a Basic Assessment process for the proposed project.

Status:

On 1 December 2015 the Department of Environmental Affairs and Development Planning (“DEA&DP”) granted and issued an Environmental Authorisation for the project in terms of the National Environment Management Act (No. 107 of 1998) (NEMA), as amended.  This gives CoCT authorisation to implement the proposed project.

The Environmental Authorisation outlines, amongst others, the decision, the activities authorised, conditions of authorisation, reasons for the decision and the appeal process (as outlined in Chapter 7 of the Environmental Impact Assessment Regulations 2010).   A copy of the full EA is available for download below. 

Any person who wishes to appeal against the Environmental Authorisation issued for the proposed project must lodge a Notice of Intention to Appeal with the Minister within twenty (20) days of the date of the Environmental Authorisation.  A Notice of Intent to Appeal must be submitted to Mr Jaap de Villiers by means of one of the following methods:

The appeal must be submitted within thirty (30) days after the lapsing of the twenty (20) days provided for the lodging of the Notice of Intention to Appeal.  Appeals must also be submitted in writing to Mr de Villiers as per the contact details provided above. Note: No appeals and responding/answering statements may be lodged via e-mail.

Please note that should you wish to appeal, the appellant must serve on the applicant, within ten (10) days of having submitted the Notice of Intention to Appeal with the Minister, a copy of the Notice of Intention to Appeal Form, as well as a notice indicating where and for what period the appeal submission will be available for inspection by the applicant.  The applicant’s contact details are as follows:
